Terms and Conditions

These Terms and Conditions apply to your use of the Essex Growth Agency Supply Chain Portal (the
“Platform”). By creating an account, accessing, browsing, posting opportunities, submitting applications, or otherwise using the Platform, you agree to these Terms.
If you do not agree, please do not use the Platform.

1. Definitions

In these Terms:

  • “EGA”, “we”, “us” means Essex Growth Agency and/or Essex County Council as the operator and/or sponsor of the Platform (as applicable).
  • “User”, “you” means any person or organisation that accesses or uses the Platform.
  • “Company Profile” means the business profile created and maintained on the Platform.
  • “Opportunity” (also referred to as a “Tender”) means any opportunity listing posted on the Platform.
  • “Applicant” means a User submitting an application for an Opportunity.
  • “Opportunity Owner” means the User posting an Opportunity.
  • “Content” means all information, text, images, documents, data, and materials posted or uploaded to the Platform.

2. About the Platform

The platform not only aims at local opportunities in Essex, with an initial focus on construction-related opportunities. The Platform may also provide resources, guidance, and collaboration tools.

The Platform is a facilitation tool only. We are not a procurement authority, procurement agent, recruiter, or broker (unless explicitly stated). We do not guarantee that any Opportunity will result in a contract award, shortlisting, interview, or work.

3. Eligibility and Account Registration

  • You must be able to form a legally binding contract in the UK to use the Platform.
  • You must provide accurate, current, and complete information during registration and keep your account details up to date.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity carried out under your account.
  • We may require verification checks to help ensure authenticity of businesses and users.

4. Company Profiles and Accuracy of Information

Company Profiles may include details such as business address, registration information, accreditations, turnover bands, company size, tier level, and supporting documents (e.g. policies and certifications).

  • You confirm that all information and documents you submit are true, accurate, and not misleading.
  • You must ensure you have the right to upload and share any documents, certifications, logos, images, or other materials.
  • Where expiry dates apply (e.g. certifications or insurance), you are responsible for keeping these current.
  • We may suspend or remove profiles that contain inaccurate, incomplete, or misleading information.

5. Posting Opportunities

If you post an Opportunity, you must provide a clear, complete description including requirements, deadlines, location, and any supporting documents.

  • You must ensure the Opportunity is lawful, genuine, and does not discriminate unlawfully.
  • You must not post confidential or sensitive information unless you have the right to do so.
  • You are responsible for managing your Opportunity, reviewing applications, and communicating with Applicants.
  • We may remove Opportunities that breach these Terms or applicable law, or that we reasonably consider misleading, inappropriate, or harmful.

6. Applying for Opportunities

If you apply for an Opportunity, you are responsible for ensuring your application is accurate, complete, and submitted before any stated deadline.

  • Submitting an application does not guarantee selection, shortlisting, or award.
  • Opportunity Owners may request additional information and may set their own assessment criteria.
  • Applications and related communications may be logged for audit and record keeping.

7. Matching, Recommendations, and Platform Data

The Platform may display recommendations or “match” results based on information provided in Company Profiles and Opportunity requirements (for example, trade categories, certifications, turnover, tier level, and similar attributes).

  • Matching outputs are automated and provided for convenience only.
  • We do not guarantee the accuracy, completeness, or suitability of matches.
  • Users remain responsible for their own due diligence, procurement checks, and assessment processes.

8. Acceptable Use

You must not:

  • Use the Platform for unlawful purposes or in a way that breaches any applicable law or regulation.
  • Post false, misleading, defamatory, or discriminatory content.
  • Upload malicious files or attempt to compromise the security or performance of the Platform.
  • Scrape, harvest, or misuse data from the Platform, including personal data or business contact data, without lawful basis and permission.
  • Impersonate another person or organisation.
  • Interfere with other Users’ use of the Platform.

9. Intellectual Property

  • The Platform design, structure, branding, and software are protected by intellectual property rights.
  • You retain ownership of the Content you upload, but you grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, and display it as necessary to operate the Platform.
  • You must not copy, adapt, reverse engineer, or attempt to extract the source code of the Platform except as permitted by law.

10. Confidentiality and Sensitive Information

The Platform may contain commercially sensitive information. You must treat any non-public information accessed via the Platform as confidential where it is clearly marked or where it would reasonably be understood to be confidential.

Do not upload personal data or special category data unless it is necessary and you have a lawful basis to do so. Where documents contain personal data, ensure you have appropriate consent or lawful basis and minimise data where possible.

11. Data Protection and Privacy

We will process personal data in accordance with applicable UK data protection law (including the UK GDPR and Data Protection Act 2018) and our Privacy Policy.

  • You must ensure you have a lawful basis to share any personal data you upload.
  • You must comply with applicable data protection laws when contacting other Users or using their information.
  • We may carry out cookie scans/audits and apply compliant analytics configurations to support transparency and compliance.

12. Availability, Security, and Support

We aim to provide a secure and reliable service, but the Platform is provided on an “as available” basis.

  • We may carry out maintenance, updates, or changes that temporarily affect availability.
  • We may implement security measures, monitoring, and access controls to protect the Platform and Users.
  • Support channels may be provided via the Help section of the Platform.

13. Suspension and Termination

We may suspend, restrict, or terminate your access to the Platform where we reasonably believe:

  • you have breached these Terms;
  • your account activity presents a security risk;
  • your Content is unlawful, misleading, or harmful; or
  • we are required to do so by law or regulation.

You may close your account at any time (subject to any required record retention for audit, compliance, or legal purposes).

14. Disclaimers

  • We do not guarantee that the Platform will meet every requirement of every User.
  • We are not responsible for the conduct, quality, or performance of any User or any work, contract, or procurement process that arises from Platform use.
  • All procurement, due diligence, and contractual decisions remain the responsibility of the parties involved.

15. Limitation of Liability

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited under law.

Subject to the above, we are not liable for indirect or consequential loss, loss of profit, loss of revenue, loss of business, or loss of opportunity arising from use of the Platform.

To the extent permitted by law, our total liability in connection with the Platform is limited to the amount (if any) you have paid to use the Platform in the 12 months before the event giving rise to liability.

16. Third-Party Links and Services

The Platform may include links to third-party websites or services (for example, certification bodies, insurers, or council resources). We are not responsible for the content, policies, or practices of third parties.

17. Changes to These Terms

We may update these Terms from time to time. Where changes are material, we will take reasonable steps to notify Users. Continued use of the Platform after changes take effect means you accept the updated Terms.

18. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms or your use of the Platform.
